My Crown My Glory (“We,” “Us,” “Our”) provides a SMS/MMS mobile messaging program (“Program”), which you can use by agreeing to these SMS/MMS Mobile Messaging Terms and Conditions (the “Agreement”). By opting into or participating in Our Program, you agree to this Agreement, including, without limitation, your agreement to resolve any disputes through binding arbitration on an individual basis, as described in the “Dispute Resolution” section below. This Agreement is specific to the Program and does not change any other agreements you may have with Us.
1. Program Description
Our mobile messaging Program allows users to receive promotional updates, exclusive deals, product launches, and information regarding My Crown My Glory’s natural, handmade nut-free skincare and haircare products. By opting in, you agree to receive both SMS and MMS messages concerning Our products and services.
2. Opt-In
You may join the Program by opting in through various methods, including signing up online or via application forms. Regardless of the method used to opt in, you agree that this Agreement governs your participation in the Program. You consent to receive autodialed or pre-recorded mobile marketing messages, though consent is not required for any purchase. While you agree to receive messages using an autodialer, this Agreement does not imply that all messages are sent in this manner.
3. Opt-Out
You may opt out of the Program at any time by replying with STOP, CANCEL, or UNSUBSCRIBE to any mobile message you receive from Us. Upon receipt, you will be unsubscribed, and a final confirmation message may be sent. No other method, such as emailing or verbally requesting, will serve as a valid opt-out method. You may re-enroll by following the opt-in process again.
4. Message & Data Rates
Message and data rates may apply depending on your carrier and mobile plan. The frequency of messages may vary, including recurring and additional messages based on your interactions with Us.
5. MMS Disclosure
Our messages may include multimedia content (MMS). If your mobile device does not support MMS, you will receive SMS messages instead.
6. Support Instructions
For assistance or inquiries regarding the Program, text “HELP” to the number you received the message from or email us at info@mycrownmyglory.org. Please note that emailing Us is not an acceptable method of opting out.
7. Phone Number Change
By opting in, you confirm that the mobile number provided is yours and that you are the authorized account holder. If your phone number changes, is deactivated, or forfeited, you must notify Us immediately. You will be responsible for any claims or damages that arise from your failure to update your phone number, including those resulting from violations of the Telephone Consumer Protection Act or similar regulations.
8. Disclaimer of Warranty
The Program is provided on an "as-is" basis. We do not guarantee the availability of the service at all times. Message delivery may be delayed or fail due to issues beyond Our control, such as carrier issues or device limitations. We are not responsible for such failures.
9. Participant Requirements
You must use a mobile device capable of receiving SMS/MMS messages and have a subscription with a wireless carrier that supports text messaging. Not all carriers support the Program.
10. Age Restrictions
You must be 18 years or older to participate in Our Program. If you are between the ages of 13 and 18, you may only participate with the consent of a parent or legal guardian. By opting in, you confirm that you meet this age requirement.
11. Prohibited Content
You agree not to use Our Program to send any content that is:
- Illegal, harassing, or threatening;
- Obscene, offensive, or discriminatory;
- Containing viruses or harmful code;
- Unlawful or in violation of any regulations.
12. Dispute Resolution
Any disputes arising from or related to this Agreement will be resolved through binding arbitration, in accordance with the rules of the American Arbitration Association. Arbitration will occur in Dolton, Illinois, and each party will bear their respective costs. Claims will be arbitrated on an individual basis, and class arbitration is not permitted. You waive the right to bring disputes to court or participate in a class action. This section survives any termination or expiration of the Agreement.
13. Miscellaneous
- Modifications: We may update these Terms at any time. Changes will be posted on Our website. By continuing to use the Program, you accept the revised Agreement.
- Severability: If any part of this Agreement is found to be invalid or unenforceable, it will not affect the enforceability of the remaining provisions.
- Governing Law: This Agreement is governed by the laws of the state of Illinois.
